Featured Story

For local couples navigating divorce after a spousal sponsorship, the process is fraught with unique legal challenges.

A sponsor's financial responsibility is a core issue.

When you sponsor a spouse, you enter a three-year binding contract with the Canadian government to provide for their basic needs.

This legal undertaking is not cancelled by separation or divorce.

If the sponsored ex-spouse receives social assistance within that period, the sponsor is legally obligated to repay the government in full.

For the sponsored individual, their Permanent Resident status is secure after a divorce, provided the relationship was genuine at the time of the application.

The sponsor cannot have their ex-partnerโ€™s status revoked simply because the marriage ended.

However, if the breakup occurs before the PR application is finalized, Immigration, Refugees and Citizenship Canada must be notified, which will result in the application being cancelled.
